CV2017000764 / BRETTNER / COSTELLO SMALL CLAIMS COMPLAINT/SUMMONS/ANSWER PLAINTIFF: Bruce Brettner, 2321 E Olivine Rd, San Tan Valley, AZ 85143, (480) 234-2190; DEFENDANT: Mitch Costello, 3467 Falcon DR, Gilbert, AZ 85297, (480) 547-6350. PINAL COUNTY JUSTICE COURTS, ARIZONA, Apache Junction Justice Court, 575 N. Idaho Rd - Suite 200, Apache Junction, AZ 85119. WARNING: THERE ARE NO APPEALS IN SMALL CLAIMS CASES. YOU DO NOT HAVE THE RIGHT TO APPEAL THE DECISION OF THE HEARING OFFICER OR THE JUSTICE OF THE PEACE IN A SMALL CLAIMS (DIVISION) COURT. IF YOU WISH TO PRESERVE YOUR RIGHT TO APPEAL, YOU MAY HAVE YOUR CASE TRANSFERRED TO (CIVIL DIVISION OF THE JUSTICE COURT PURSUANT TO ARS 22-504, IF YOU REQUEST SUCH TRANSFER AT LEAST TEN (10) JUDICIAL DAYS PRIOR TO THE DATE OF THE SCHEDULED HEARING. If you do not answer or defend, you run the risk of having an appropriate judgment entered against you for the amount of plaintiff's claim, plus court costs. A filing fee must be paid at the time the answer is filed. DATE: 3/13/2017. CLERK: /s/ ND. PLAINTIFF'S CLAIM. This Justice Court has venue because the debt, or cause, fraction, or incident that resulted in this claim, occurred in this precinct at the following location: 2321 E Olivine Rd 85143. $3,500.00 is the total amount owed me by defendant because: The Defendant and I entered into a contract by which the Defendant agreed to paint my 1967 Pontiac LeMans outside and inside, re-install all interior pieces, (seats, headliner, steering wheel, etc.) re-install all exterior pieces, (bumpers, headlight bezels, chrome, etc.) wet sand and buff exterior of car, and purchase and apply garage floor coating to cover all the paint he spilled, and sprayed on the floor. The paint he applied on the exterior of the car turned out absolutely horrible, as the car is covered with "orange peel", missed spots, and overspray. Naturally the cost of removal and re-painting will far exceed the cost of having it done properly the first time. In return the Defendant was to pay me $4,000.00 combined with the paint job for a 1972 Chevrolet Chevelle I own. I allowed the Defendant to take said Chevelle to his garage so he could repair a couple interior issues and address an oil leak. The Defendant who claimed he could fix the paint job and never began work on the other items we had agreed on, proceeded to skip town taking my Chevelle along with him. I'm asking the court for the return of my Chevelle and $3,500 in punitive damages for breach of contract, stealing my Chevelle, and mental anguish. DATE: 3/10/17. PLAINTIFF: /s/ Bruce A.
