Case No.: 2021-EMS-T0086-DHS / Buckeye Valley Rural Volunteer Fire District (EMS 00574) NOTICE OF INTENT TO WAIVE HEARING TO ADJUST RATES AND CHARGES BEFORE THE DIRECTOR OF THE ARIZONA DEPARTMENT OF HEALTH SERVICES In the Matter of: Buckeye Valley Rural Volunteer Fire District dba Buckeye Valley Volunteer Rescue Unit Applicant PURSUANT TO an application filed on May 18, 2020 ("Application"), Buckeye Valley Rural Volunteer Fire District dba Buckeye Valley Volunteer Rescue Unit ("Applicant"), requests an adjustment (increase) to various current approved rates and charges in accordance with Arizona Administrative Code ("A.A.C.") R9-25-1102. PURSUANT TO Arizona Revised Statutes ("A.R.S.") §§ 36-2232(A)(1), 36-2239, and 36-2234(C) the Director of the Arizona Department of Health Services ("Director") may adjust rates and charges and waive the hearing normally required by A.R.S § 36- 2234(A) for such action. THE DIRECTOR GIVES NOTICE that unless a written request for hearing regarding this Application is received by the Clerk of the Department, Office of Administrative Counsel and Rules, Arizona Department of Health Services, 150 North 18th Avenue, Room 200, Phoenix, Arizona 85007, by 5:00 p.m., July 15, 2021, the Director may approve the application for adjustment of rates and charges based upon the following information and other evidence currently on file: 1. The Applicant holds a current Renewal Certificate of Necessity No. 8, which expires on August 31, 2021. 2. The Applicant's current approved rates and charges became effective on August 2, 2019. 3. The current approved rates and charges which have not been amended since the above date are as follows: A. ALS Base Rate $ 1,206.98 B. BLS Base Rate $ 1,206.98 C. Mileage Charge (Patient Loaded Miles) $ 15.38 D. Standby/Waiting Charge (Per Hour, $ N/A After 15 Minutes to Load and/or Unload) E. Subscription Rate $ 301.76 F. Disposable Medical Supplies Charges Not Allowed 4. The Application to amend its current rates and charges was initially filed by the Applicant on May 18, 2020 and additional information was submitted on October 1, 2020. In the Application, the Applicant requested the following rates and charges: A. ALS Base Rate $ 1,360.73 B. BLS Base Rate $ 1,360.73 C. Mileage Charge (Patient Loaded Miles) $ 16.48 D. Standby/Waiting Charge (Per Hour, $ 340.18 After 15 Minutes to Load and/or Unload) E. Subscription Rate $ N/A F. Disposable Medical Supplies Charges Not Allowed 5. The Bureau of Emergency Medical Services & Trauma System ("BEMSTS") evaluated the Application, and subsequently proposed the following rates and charges as being reasonable for the Applicant: A. ALS Base Rate $ 1,360.73 B. BLS Base Rate $ 1,360.73 C. Mileage Charge (Patient Loaded Miles) $ 16.48 D. Standby/Waiting Charge (Per Hour, $ 340.18 After 15 Minutes To Load and/or Unload) E. Subscription Rate N/A F. Disposable Medical Supplies Charges Not Allowed 6. The Applicant's justification for the proposed rates and rate increase, as described in its Application filed with the BEMSTS on May 18, 2020, is as follows: "The district would like to maximize ambulance service revenue and offset current operating loss. The current staffing model is based on the best solution to serve the community however this results in an operating loss." 7. Details of the Applicant's request for a general rate adjustment are open to the public and are contained in its Application on file with the Clerk of the Department, Office of Administrative Counsel and Rules, Arizona Department of Health Services, 150 North 18th Avenue, Room 200, Phoenix, Arizona 85007.
