Wiley and The George And Kimberley Wiley Family Trust Dated 9/23/2016: We represent Arizona Financial Credit Union, a federally insured credit union as successor to Horizon Community Bank ("Lender") whose address is 333 North 44th Street, Phoenix, Arizona 85008. Lender has advanced two (2) loans (the "Loans") to Arizona's Interior Innovations LLC, an Arizona limited liability company ("Borrower"). You, George D. Wiley, Kimberley A. Wiley and The George And Kimberley Wiley Family Trust Dated 9/23/2016 ("Guarantors"), have personally guaranteed repayment of the Loans. To secure payment of the Loans, Borrower, as debtor, has pledged to Lender, as secured party, a security interest in and lien upon all of Borrower's: "Inventory", "Equipment", "Accounts", "Chattel Paper", "Instruments", "Investment Property" and "General Intangibles" and "Proceeds" thereof as such terms are defined by the Uniform Commercial Code as enacted in Arizona (the "UCC") (collectively, the "Business Assets Collateral"). Lender has perfected a lien upon said Business Assets Collateral by filing two (2) Uniform Commercial Code-1 financing statements with respect to the Loans with the Secretary of State of Arizona on December 16 2020, as File Nos. 2020-008 -3197-3 and 2020-008-3199-4. Additionally, to further secure the Loans, Borrower has pledged to Lender a security interest in and lien upon a Crown Upright Model 30SP42TT Forklift bearing Serial No. W60709 (the "Forklift"). Lender has perfected a lien upon said Forklift by filing a UCC-1 financing statement with respect to the Loans with the Secretary of State of Arizona on December 16, 2020, as File No. 2020-008-3198-7. Additionally, to further secure the Loans, Borrower has pledged to Lender a security interest in and lien upon the following five (5) motor vehicles (the "Vehicles"):1999 Isuzu NPR VN (VIN No.# JALB4B146X7011059) 2005 Toyota Tundra Truck (VIN No.# 5TBRT34145S469303) 2016 Ford T250 Van (VIN No.# 1FTYR1ZM2GKA90710) 2016 Isuzu NHD TK (VIN No.# 54DC4W1B7GS802124) 2021 Mercedes-Benz Sprinter Van (VIN No.#W1Y4DBHY9MT062492)Lender has perfected its liens upon the Vehicles by noting them on the Certificates of Title to the Vehicles issued by the Arizona Department of Motor Vehicles. This letter serves as notice to Borrower, Guarantors and junior lienholders with an interest in the Business Assets, Forklift and Vehicles (the "Collateral") as required by A.R.S. §47-9613 that Lender shall sell the Collateral at the law office of Folks Hess, PLLC, Suite 1140, 1850 North Central Avenue, Phoenix, Arizona 85004 (the "Auction Location") by a private or public sale pursuant to the standard policies and procedures of Lender and the requirements of the UCC for liquidation of personal property sometime after April 3 2023 (the UCC Sale'). Lender's present intention is to conduct the UCC Sale of the Collateral via a public auction sale on Tuesday, April 4, 2023, at 9:30 a. m. to be administered by Folks Hess , PLLC at the Auction Location. Borrower, Guarantors and junior lienholders are entitled to an accounting of the unpaid indebtedness owing to Lender and secured by the Collateral that Lender intends to sell at the UCC Sale.
